The website www.bethewellbeing.com is managed by Ine Verlinden. Be The Wellbeing is the controller for the processing of your personal data within the meaning of the AVG Act and the Personal Data Protection Act (hereinafter: PDPA).

What are personal data?

Your personal data at Be The Wellbeing. Below we provide a comprehensive summary of how Be The Wellbeing collects and stores personal data, and why.

What is personal data? Any piece of information with which you identify a person. Also your business email address or an IP address. That is why the privacy rules apply to both companies and consumers.

What data do we collect?

When you register online for our 6 keys, fill in the contact form, request a quote or make other requests for one of our services, you will be asked to fill in information. In that case, we only process the data that you provide yourself. This can be the following data:

  • First and last name

  • E-mail address

  • (Personal) website

  • Phone number or skype address

  • Company Name

  • Street and house number

  • Residence

  • VAT number

Additional information regarding career guidance with career checks from VDAB:

  • Data for the registration module (name, check number)

  • Paper/digital check (name, check number)

  • Any test results that we collect as a center about the citizen in the context of guidance

  • File with notes about the guidance, on paper or digitally

  • PDP written by the customer

The career center makes an inventory of this data and stores it in accordance with the instructions in the processing agreement with VDAB. Other information that we collect in the context of career guidance is only considered relevant for those specific coaching sessions and is not stored.

For what purpose are the personal data used?

The data is collected and stored for the following purposes:

  • We use your name and e-mail address to send news, commercial newsletters and retargeting for Facebook advertisements. We only do this with data obtained by downloading free documents, not with data received via our contact or quotation forms. We never add your email address to a mailing list ourselves.

  • Your name, e-mail address, website if applicable, and telephone number and/or Skype address that you enter in a form for a quotation request, are used to be able to make a quotation. Such form will be sent to our mailbox and will be kept there for 5 years. Until you become a customer with us, we do not put this data in our email marketing system.

  • When you fill in the contact form, your name and e-mail address are required to be able to provide you with a response.

  • We use your name, email address and physical address to create invoices when you purchase a service.

By providing the data you give us permission to use the data for the above purposes. In addition, some of this data is necessary for the execution of the agreement, if certain services have to be performed for you. We therefore process your data on the basis of Article 8 sub a and sub b PDPA.

Mailingprovider

Your personal data is stored on servers of a mailing provider such as MailChimp. This is only possible if you have registered yourself for our newsletter, which you will not automatically enter if you follow career guidance with us. MailChimp's servers are located in the United States. Your data can therefore be transferred, stored and processed in the United States. This transfer of this data only takes place on the basis of the EU-US Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Check how MailChimp handles the privacy of your data.

Retargeting

In addition, we share data obtained by downloading a free document with Facebook in order to create advertising target groups. More information about Facebook's privacy policy can be found here. Your data may also be transferred by Facebook to the United States. This transfer of data also takes place on the basis of the EU-US Privacy Shield Framework. Varia

There are still a few companies that may have access to your data, including the accountant, web host and of course our coaches and trainers. We have concluded a processing agreement with these people so that it is clear how they protect your data. Security personal data

We have taken appropriate technical measures to protect personal data against loss or other forms of unlawful processing. These measures, including encryption through an SSL certificate, ensure a security level that matches the data we process.

Storage period

We do not store your data longer than necessary for the purpose for which it was received.

  • When you unsubscribe from emails, you will be placed on an unsubscribe list that will NOT be emailed anymore. However, you will remain in the system for a maximum of one year until we completely remove the unsubscribe list.

  • If you have received career guidance with career checks from VDAB, your file will be kept in accordance with the legal obligations. When you are a customer, the invoices with your data are treated with a retention period in accordance with legal obligations. The above term applies, unless there are further legal obligations for us to keep the data for longer and/or to keep it available.

Data breach notification obligation

Be The Wellbeing has the obligation to report data breaches. Is personal data missed or lost? Then we will report this to the Dutch Data Protection Authority. In the event of a serious data breach or danger to the persons behind it, we must also inform the persons concerned directly. If it concerns data from our coachees in career guidance with career checks from VDAB, we have the obligation to notify VDAB as they are our controller as a career center. On 24 May 2022, there were no data leaks at Be The Wellbeing.

Rights

You always have the right to withdraw your consent to the processing of your data, after which we will no longer process your data. Withdrawing this consent does not affect the lawfulness of our data processing based on your consent, which took place before this withdrawal.

You also have the right to inspect your personal data and the right to rectify your personal data. If you want to know which personal data we process about you, you can submit a written request for access. If your data is incorrect, incomplete or irrelevant, you can request us in writing to change or supplement your data.

In addition, you have a right to erasure of your personal data, a right to restrict processing and a right to object to the processing. In addition, you have the right to transfer or make your data transferable. You can also make a written request for this.
